GENERAL CONTRACT CONDITIONS
This document establishes the general conditions of the contractual relationship that is aimed at the sale of products offered from this website, and which is owned and operated by RAMÓN SEGARRA ROVIRA with address at Carrer Madrazo, 127, CP 08021 de Barcelona, with NIF (TIN): 35023746-J (hereinafter, “ROVIRA HOME SUPPLIES”, and the natural and / or legal persons (hereinafter, “CUSTOMER”) who express their willingness to buy the products through the request made via the Internet through this website. All the rights that the current Laws recognize to consumers and to which reference may be made here, will apply exclusively to customers who are considered to be consumers and who act with a purpose other than their commercial, business, trade and professional activity.
The orders placed by users constitute the specific conditions associated with the present General Terms and Conditions that the CUSTOMER must necessarily accept electronically before proceeding to purchase any goods. The present conditions are presented to the CUSTOMER via this same website, to be read, printed, filed and accepted. These general conditions together with the request for the specific products made by the CUSTOMER imply the formalisation of the sale contract between ROVIRA HOME SUPPLIES and the CUSTOMER who affirms to have read, understood and accepted these conditions. The CUSTOMER can consult these general conditions through the website at any time.
FIRST: PURPOSE OF THE CONTRACT.
By these General Conditions, ROVIRA DRUGSTORE undertakes to deliver to the CUSTOMER the products that they have requested through the website in exchange for a certain price.
By purchasing the products available on this website, the CUSTOMER declares:
- That they are a person of legal age and with the capacity to enter a contract.
- That they have read, understood and accept these General Contract Conditions.
SECOND: ALTERATION OF THE GENERAL CONDITIONS.
ROVIRA HOME SUPPLIES reserves the right to modify the present General Conditions at any time, without any obligation to communicate it previously to the CUSTOMER, who in any case, is responsible for reviewing them as a prerequisite for acquiring any product available through this website. In any case, the General Conditions that were shown on the website will be considered valid and applicable at the moment that the CUSTOMER acquires the corresponding products.
THIRD: RIGHTS AND OBLIGATIONS OF ROVIRA HOME SUPPLIES.
3.1. Product delivery.- ROVIRA HOME SUPPLIES undertakes to deliver the product in perfect condition to the address indicated by the CUSTOMER in the order form, which contains the specific conditions attached to these General Conditions.
ROVIRA HOME SUPPLIES will not be responsible for errors caused in delivery when the details entered by the CUSTOMER in the order form do not conform to reality or has been omitted. The approximate delivery time for each product is indicated in its file, in no case exceeding the period of fifteen days (deliveries will only be made within the territory of the European Union and the Principality of Andorra). ROVIRA HOME SUPPLIES will not be responsible for delays in delivery caused exclusively by causes attributable to the transport agency or unforeseeable and uncontrollable factors that it does not have a duty to bear.
In case of lack of availability of the requested product, ROVIRA HOME SUPPLIESwill inform the CUSTOMER of this fact and the expected delay will be communicated by email or at the telephone number provided by the CUSTOMER. Then ROVIRA HOME SUPPLIES may give the CUSTOMER the option to cancel their order or buy an alternative item that has been offered. If no response is received, it will be understood that the CUSTOMER wishes to wait for the given period.
Should it be impossible to supply the requested product, either due to lack of supply from ROVIRA HOME SUPPLIES’ suppliers or for any other reason, the CUSTOMER will also be informed of this fact and the order will be canceled without any penalty, committing ROVIRA HOME SUPPLIES to the full refund of the amount of the purchase within a maximum period of 15 days, except for special conditions identified, where appropriate, in the product description itself.
3.2. Responsibility of ROVIRA HOME SUPPLIES. In no case will it be responsible in relation to:
3.2.1. Errors or delays in the CUSTOMER’s access to the website upon entering his or her data on the order form, if confirmation of the order is slow or cannot be received or any issue arising when the incidents are due to problems on the Internet, unusual events or force majeure and any other unforeseeable contingency beyond the company’s good faith. In any event, ROVIRA HOME SUPPLIES agrees to solve the problems if any arise and to offer all necessary support to the client to reach a quick and satisfactory solution of the incident.
3.2.2. Errors or damages in or to the website due to a CUSTOMER’s inefficient or misuse of the service.
3.2.3. The e-mail address provided by the CUSTOMER to send the confirmation of the order not being operational or experiencing problems.
3.3.1. ROVIRA HOME SUPPLIES guarantees that all Products available for sale on the website comply with international and community standards applicable to product safety.
3.3.2. The warranty that applies to the Product when it is delivered to the CUSTOMER is nine months, as long as the Product is used by the CUSTOMER under normal conditions of use, such as those detailed in the Product description and in the catalogues posted. at the disposal of the CUSTOMER. In no case is it guaranteed that the Product supplied is capable of responding to a particular problem of the end user.
3.3.3. The shipping costs to the warehouse for defective products within the warranty period are paid by the CUSTOMER, ROVIRA HOME SUPPLIES agrees to pay the costs of returning the product to the CUSTOMER’s address.
4. Right of withdrawal:
ROVIRA HOME SUPPLIES recognises that the CUSTOMER has the right of withdrawal in the terms and deadlines recognised in Royal Legislative Decree 1/2007 of November 16, in this case ROVIRA HOME SUPPLIES will reimburse the CUSTOMER the amount paid for the price and applicable taxes as well as shipping expenses, to the account number indicated by the CUSTOMER. The CUSTOMER has a period of 14 days from the date of delivery of the Product to exercise the right, the date indicated in the delivery document signed by the CUSTOMER being considered as such, unless proven otherwise. In order to exercise this right, the CUSTOMER must send an email to firstname.lastname@example.org and notify ROVIRA HOME SUPPLIES within the established deadline, also sending the corresponding product. In any case, the CUSTOMER will be responsible for the costs directly incurred by returning the aforementioned product, as well as any damage caused to it as a result of its return.
The right of withdrawal recognised in this clause is understood to be without prejudice to the exceptions to the same that the legislation itself establishes. By way of example and not exhaustive, this right may not be exercised in relation to goods that, due to their nature, cannot be returned or may deteriorate, expressly including products that have been personalised at the consumer’s request.
FOURTH: RIGHTS AND OBLIGATIONS OF THE CUSTOMER.
4.1. Payment.- The CUSTOMER agrees to pay in advance the price asked for the Product in the following amount and method:
4.1.1. Amount.- The amount paid for the Product requested by the CUSTOMER will be that indicated on the website and that which appears at all times on the CUSTOMER’s request form, such request forms will constitute the particular conditions of the order. The prices of the products that appear on the website include VAT.
The relevant shipping costs must be added to the price that appears on the website for each of the products offered. ROVIRA HOME SUPPLIES, is obliged to always inform the CUSTOMER of the cost of shipment before making the purchase final and once again in the confirmation email.
4.1.2. Payment methods.- The CUSTOMER must pay the amount corresponding to his order by:
-Credit card: entering your data in the virtual POS on the website. By accepting this means of payment, the CUSTOMER confirms that they are authorised to use the card for this purpose, and that they are the cardholder. Card payments are subject to the provisions of Law 19/2018, of November 23, on payment services and other urgent measures in financial matters, especially everything related to payment orders and the conditions for their revocation.
-Cash on delivery: for which the CUSTOMER will pay the cost of the online order directly to the person who delivers it.
4.2. Responsibility of the CUSTOMER.- In any event, it will be the responsibility of the CUSTOMER:
4.2.1. The CUSTOMER assumes all risks of deterioration, impairment, damage and loss of the Products from the moment they have been made available to him by the third party who, on behalf of ROVIRA HOME SUPPLIES, delivers the requested products.
4.2.2. The CLIENT undertakes to check the good condition of the Product in the presence of the third party who, on behalf of ROVIRA HOME SUPPLIES, delivers the requested product, indicating at the same time any unusual condition that may be detected in the packaging.
If later, after reviewing the content, the CUSTOMER detects any incident such as a blow, breakage or any damage caused by the shipment, he agrees to notify DROGUERIA ROVIRA within a period of no more than 24 hours after receiving the product.
5.1. ROVIRA HOME SUPPLIES will in no circumstances be responsible for:
5.1.1. the production of any type of damage that the CUSTOMER or third party could cause on the website.
5.2. ROVIRA HOME SUPPLIES reserves the right to suspend all access to this website without prior notification, subject to discretion permanently or temporarily, until the effective responsibility for any damages that may occur is established. Furthermore ROVIRA HOME SUPPLIES will notify and assist the relevant authorities regarding any incident once it has firm knowledge that the damages caused constitute any type of illicit activity.
SIXTH: COPYRIGHT AND BRAND.
ROVIRA HOME SUPPLIES asserts that the original content, the programming and the design of the website are fully protected by copyright, and any reproduction, communication, distribution and transformation of the aforementioned protected elements are expressly prohibited except with the express consent of ROVIRA HOME SUPPLIES. The brands of the products that ROVIRA HOME SUPPLIES sells through the website belong to their legitimate owners. ROVIRA HOME SUPPLIES may establish links or hyperlinks to articles or information from third parties, always citing the source. The legitimate holder of the copyright of any information included in this way may request, at any time, the removal of said references.
SEVENTH: JURISDICTION AND APPLICABLE LAW.
These general terms and conditions are governed by Spanish law. To determine the place of the sale to which these General Conditions are subject, refer to the provisions of article 29 of Law 34/2002, of July 11, on information society services and e-commerce. In the event that the CUSTOMER is not considered a consumer, any conflict related to the interpretation or execution of these General Conditions of Contract shall be subject to the jurisdiction of the Courts of the city of Barcelona.
EIGHTH: ANULMENT OF CLAUSES.
In the event that any provision of these General Terms and Conditions is declared invalid, the remaining provisions shall remain in force and shall be interpreted taking into account the will of the parties and the purpose of these General Terms and Conditions. ROVIRA HOME SUPPLIES may not make use of some of the rights or provisions stated in this document, which shall not mean in any case their waiving those rights, except by express recognition from ROVIRA HOME SUPPLIES.
NINTH: ALTERNATIVE PROCEDURE FOR RESOLVING ONLINE DISPUTES.
Without prejudice to what is indicated in the previous clause, the European Commission provides an online dispute resolution platform that is available at the following link: http://ec.europa.eu/consumers/adr/. CUSTOMERS who have the status of consumers, may submit their claims through the online dispute resolution platform.
